NOTICE OF PRIVACY PRACTICES (NPP)

This notice describes how medical and wellness information about you may be used and disclosed, as well as how you gain access to this information. Please read it thoroughly and with full attention. 

OUR LEGAL & ETHICAL DUTY

At ARCĨ Wellness LLC, we believe your personal story is the most sacred part of your "Internal Architecture." According to professional standards and relevant laws, we must: 

• Maintain the privacy of your Protected Health Information (PHI)

• Provide you with this notice regarding our legal duties and privacy practices. 

• Notify you following a breach of your unsecured PHI

We reserve the right to amend our privacy practice and this notice at any time, provided the changes are permitted by law. We will update this notice before making any significant changes to our practices.

YOUR PROTECTED HEALTH INFORMATION (PHI)

Your information - including coaching notes, wellness history, and movement assessments will not be used or disclosed without your written permission, unless required by law.

OCCASIONS WHERE CONSENT IS NOT REQUIRED:

• Treatment & Coaching: We may use your PHI in connection with our business operation, such as quality assessment and improvement activities. 

• Health-Related Operations: We may use your PHI in connection with our business operations, such as quality assessment and improvement activities.

OTHER PERMITTED DISCLOSURES

• Emergency Treatment: If you require emergency medical care, we may disclose PHI if we are unable to obtain your consent due to the nature of the emergency. 

• Legal Requirements: We may disclose PHI when compelled by federal, state or law enforcement officials. 

• Public Safety (Mandatory Reporting): We may disclose your PHI if it coincides with the Mandatory Reporting Laws of our state, which refer to credible threats to your safety or the safety, health, and welfare of others.

YOUR RIGHTS REGARDING YOUR PHI

• Access: You are entitled to see and obtain copies of your PHI. All request must be submitted in writing. We will provide a response within 30 days. You may be charged a a reasonable, cost based fee for copies or summaries. 

• Accounting of Disclosures: You may request a list of the instances in which we have discord your PHI for purposes other than treatment or health operations. This list will be provided within 60 days. 

• Amendments: You may request that we correct or add to PHI that you believe in inaccurate or incomplete. This request must be in writing with an explained reason. We may deny your request if the information is deemed accurate, complete, or was not authorized by our firm.
